The New European ESG Supply Chain Regulations and the Impact on Thailand

Europe-in-Review (EiR) Seminar on Current Developments in the EU and for the Cooperation between Europe and Southeast Asia

The global landscape of corporate responsibility and sustainable business practices regarding environmental, social, and corporate governance (ESG) values, including the responsibility for the supply chain, has been rapidly evolving over the past years. The European Union's (EU’s) Corporate Sustainability Due Diligence Directive (CSDDD), proposed by the European Commission in February last year and adopted by the European Parliament in June this year, is the latest in the string of legislations and initiatives in Europe aimed at ensuring responsible sourcing, ethical practices, and compliance with labor and environmental regulations in business throughout the supply chain.

The CSDDD is closely aligned with the EU Corporate Sustainability Reporting Directive, that entered into force in January, and is in line with a legislative trend on national level in Europe reflected in the French Duty of Vigilance Law (2017), the Dutch Child Labour Due Diligence Law (2019), the Norwegian Transparency Law (2021), the Swiss Due Diligence in Obligations Law (2021) and the German Supply Chain Act that has been in force since January.

 

Establishing a corporate due diligence duty, that comprehensively includes “identifying, bringing to an end, preventing, mitigating and accounting for negative human rights and environmental impacts in the company’s own operations, their subsidiaries and their value chains,” the CSDDD holds immense implications for companies as well as for legislators and governments.

 

The CSDDD has direct impact on Thai companies exporting to the EU and/or supplying EU firms with parts, components or materials, and the question arises if Thailand is positioned to embrace and implement the directive effectively.

 

Against this backdrop, the seminar will introduce the core provisions of the CSDDD and explore concerns and challenges arising from the directive’s implementation, such compliance costs, potential competitiveness imbalances, and the need for harmonization between EU and Thai sustainability frameworks. Involving a wider perspective of relations between the EU and Thailand, the seminar will also discuss how the CSDDD aligns with the EU-Thailand Partnership and Cooperation Pact, signed in December, and the relaunch of negotiations on the EU-Thailand free trade agreement.
