The new instrument empowers the European Commission to collect data and request information directly from companies and business associations in the event of a “serious difficulty” with the application of Union law. The request could relate to highly sensitive company data such as cost structure, pricing policy, profit, work contracts and supplier relations. No individual instance of poor conduct by the company or association in question is necessary for the information right to be triggered. With the data collected, the European Commission hopes to gather information to help smooth out single market disruptions. The instrument has been highly criticized by Member States and business representatives of being disproportionate. Our workshop will discuss the instrument, its structure and chances, its risks for companies, it’s added value for the Single Market and possible solutions of how to improve the Commission proposal. The workshop will be held in English language.
