Many countries and jurisdictions face a common but difficult challenge of balancing economic development with energy security and environmental and climate mitigation constraints. To achieve the goal of Paris Agreement and the carbon neutrality target which has been adopted by several jurisdictions in Europe and Asia, carbon capture, utilization and storage (CCUS) plays a very important role. By providing an alternative to allow continued use of fossil fuels, CCUS is considered as a viable solution with available technologies to capture and isolate CO2 from the carbon intensive industries. To date, experimentations of CCUS have been carried out in North America, Europe, Middle East and Asia. However, commercialization of CCUS has had a slow progress, mainly due to the high capital costs required and the lack of a regulatory framework that encourages investment and responsible operation. This seminar will discuss the legal and regulatory issues on CCUS development in Europe and Asia from a comparative perspective.
