6th UCEP Monitoring Report

The monitoring report of the UCEP NGO for the period 2014 – first half of 2021 provides assessments of Ukraine’s progress in fulfilling a set of obligations that are clearly linked to the articles of the Agreement, its annexes or the provisions of other international agreements specified in the Agreement. The report was published by the NGO "Ukrainian Center for European Policy" (UCEP) on the basis of independent evaluations of Ukrainian experts and supported by the Konrad-Adenauer-Stiftung Ukraine (Kyiv).

The purpose of the report is to highlight the progress of Ukraine in fulfilling the obligations defined in sections II, III, IV, V and VI of the Association Agreement, which took place during 2020 - the first half of 2021.

Detailed description of the progress in implementation of the commitments for the period of 2014-2019 was covered in the preliminary monitoring report "UKRAINE AND THE ASSOCIATION AGREEMENT: IMPLEMENTATION MONITORING 2014-2019".

The monitoring report for 2014 - the first half of 2021 covers 24 full-fledged sectors, which are the main structural part of the monitoring report and, in turn, are divided into 111 thematic areas.

The progress measurement unit is a commitment, which implies a specific set of actions or on the part of the Ukrainian authorities aimed at transposition (gradual regulatory approximation) and implementation (practical enactment) to the requirements of one or more European Union acquis, as specified in the articles of and Annexes to the Association Agreement with the EU.

The first part of the report provides an assessment of Ukraine’s progress in fulfilling its obligations under the Association Agreement between Ukraine and the EU during 2014 - the first half of 2021.

The second part of the report offers key conclusions and recommendations on sections II, III, IV, V, VI of the Agreement for its more effective implementation.

Therefore, as of the second half of 2021, the overall progress in fulfilling the obligations under the Association Agreement between Ukraine and the EU is 49%.

This assessment includes both fully implemented commitments and achieved intermediate results. "Perfect" execution, i.e., when the tasks stipulated by the obligation are fully fulfilled, amounts to 25.6%. 22.7% is “advanced” implementation, which means that legislative work has been carried out, but all the necessary subsidiary-laws have not been adopted and/or implemented, or certain actions for practical implementation have not been completed.

24.9% - "early" stage of implementation - when regulations or measures for their implementation are at the development stage. For another 24.9% of obligations, execution has not even begun. Compared to the previous study on the implementation of the Agreement, there is an increase in the indicator of overall progress (from 41.6% to 49%), especially the indicator of perfect implementation (from 12.4% to 25.6%).

Currently, it can be affirmed that more than a quarter of the obligations stipulated by the Association Agreement have been fully implemented by Ukraine.

Leading sectors (having more than 55% of the total progress in fulfilling obligations) according to the results of the analysis for 2020 – first half of 2021 remained unchanged.

The following sectors received the highest scores of “Absolutely”: technical barriers to trade (TBT); state procurements; company activities; foreign, security and defense policy, power engineering; taxation and consumer protection; and the telecommunications and domestic reform cooperation sectors.

Numerical assessments of the progress are carried out by experts and are accumulated in the database of the associated online monitoring product "Association Agreement Navigator" hosted on the “European Pravda” website.
