Innovating and Improving the Efficiency of Law Implementation Organization in the Period 2025 – 2030

Workshop co-organized by KAS Vietnam and Ministry of Justice

In recent years, Vietnam has made significant strides in perfecting its legal system to regulate all aspects of economic and social life. However, while the legislative process has achieved notable progress, the organization and enforcement of laws have not kept pace with development requirements, revealing certain shortcomings and limitations. One of the main reasons for this situation is the lack of full institutionalization in law enforcement organization. In 2023, the Vietnamese Government issued Resolution No. 77/NQ-CP, outlining an action program to implement Resolution No. 27-NQ/TW issued by the 13th Party Central Committee in 2022. Resolution No. 27-NQ/TW emphasizes innovation in the law enforcement mechanism, closely linking law development and implementation to ensure effective, and efficient enforcement.

Therefore, on 17 May, the workshop “Innovating and Improving the Efficiency of Law Implementation Organisation in the Period 2025-2030” co-organized by Konrad-Adenauer-Stiftung Vietnam and Ministry of Justice/ Department of Management of Handling of Administrative Violations and Monitoring of Law Implementation focused on administrative and law enforcement monitoring, aiming to assess the current state of law enforcement organizations and activities in Vietnam. Based on this assessment, the workshop analyzed and identified results, limitations, and the underlying causes of inadequacies in the deployment and implementation of law enforcement across ministries, industries, and localities. The workshop took place in the framework of the bilateral Rule-of-Law Dialogue between Germany and Vietnam

 

The workshop had the participation of numerous representatives of relevant organizational units from the executive, judicial and legislative branches and from a total of 30 provinces.

Addressing at the workshop, Vietnam Deputy Minister of Justice Dang Hoang Oanh emphasized the critical role of building and organizing law enforcement. These tasks are essential for establishing a social rule-of-law state. Mr. Florian Feyerabend, Resident Representative of KAS Vietnam, highlighted the interdependence between a strong rule of law and effective administration. Transparency and verifiability in state management activities are prerequisites for optimizing administrative processes. Moreover, Mr. Feyerabend emphasized that even the best law is ineffective if it is implemented incorrectly, leading to significant impacts on economic and social life. As the demands on national governments increase, so do the demands on administration. The tasks become more complex, and interdependencies intensify. The monitoring of the effectiveness of laws must be able to keep pace with these developments or, in the best case, be one step ahead. Successful institutionalization of impact monitoring requires collaboration among relevant authorities at all administrative levels, across departments, and in meaningful dialogue.
