Session One: THE RELATION BETWEEN CONSTITUTIONAL REVIEW ORGANS, GOVERNMENTS AND THE ORDINARY JUDICIARY

(Judgements in constitutional matters often affect decisions by the Government or the ordinary courts. Thus, the question arises how far should a ruling of a Constitutional Court interfere in the domain of the government that – in turn – is responsible to parliament. In some cases, the limits of power of each of these organs are determined by the court’s decision. Participants shall discuss the balancing function of a Constitutional Court between other state organs safeguarding the principle of separation of powers.)

Session Two: CONSTITUTIONAL ADJUDICATION VIS-À-VIS THE LEGISLATURE

(Binding interpretation of the Constitution often affects legislative acts passed by a parliamentary majority. Subsequently, laws are declared unconstitutional – in full or in part – and the lawmakers are asked to pass new legislation which is in line with the respective ruling of the court. In this session participants shall elaborate on how they see their role in relation to parliaments as the representatives of the people and lawmakers.)
